The ruling was made under the controversial unlawful combatant law, which critics argue undermines legal protections for individuals accused of security threats.
Dr. Abu Safiyah, 52, was arrested on 27 December 2024, amidst a raid on his hospital by Israeli forces, an action that was widely condemned by human rights advocates. The Southern District Prosecutor's Office presented a confidential file to the court, claiming that he posed a security risk. However, his legal representative from the Al-Mezan Centre for Human Rights argued that Dr. Abu Safiyah was solely engaged in providing medical care and administrative services, not participating in any unlawful activities.
The prosecution's refusal to disclose the evidence against him raises significant concerns about the transparency of the legal process.
