ICJ Review of Gaza Blockade Exposes Western Hypocrisy, Says Legal Expert

Legal advisor Osama Saad has described the United Nations' referral of Israel’s blockade of Gaza to the International Court of Justice (ICJ) as a significant legal step—but one hindered by Western double standards and political obstruction. While the ICJ’s opinion can reaffirm the illegality of the blockade under international law, its power remains largely symbolic due to the absence of enforcement mechanisms.

"The court cannot impose its rulings—especially in advisory matters," Saad explained, highlighting that Israel deliberately avoids international legal forums because it knows its position is indefensible.

He criticised the United States for repeatedly using its veto at the UN Security Council to block resolutions aimed at holding Israel accountable. This protection, Saad argued, has allowed Israel to disregard international law, ignore UN resolutions, and act with impunity.

He pointed to the bitter irony that the post-World War II legal order—designed to prevent atrocities—is now being undermined by those meant to uphold it. "Those once shielded by international law are now violating it in Gaza through displacement, starvation, and collective punishment," he said.

Despite its limitations, Saad maintained that bringing the blockade before the ICJ represents a symbolic victory, one that reinforces the global recognition of Israel’s actions as unlawful and morally indefensible.
